Medical Record Review
Dr. Nygaard personally reviews the records forwarded to him, analyzing provider medical records, X-rays, MRI scans, surgical operative reports, and rehabilitation records. He will provide opinions on diagnoses of complex conditions, causation, apportionment, permanent damages, reasonable medical care and treatment, and functional impairment. His opinions regarding a case are provided in a detailed, comprehensive report.
Expert Witness Testimony
Dr. Nygaard will provide Independent Medical Examinations (IMEs) on your client and provide a detailed, concise report.
He approaches each Claimant from a neutral viewpoint. Opinions are formed after a review of prior medical records, gathering a comprehensive history and noting consistency with prior records, a detailed physical examination along with observations of the Claimant's movements and pain behaviors.
A straightforward examination entails 90-120 minutes, while a complex examination may extend 120-150 minutes.
Preparation of the report begins immediately, with content and formatting completed by him, and reports available in 48-72 hours. Necessary internet research, variable from Claimant to Claimant, and examples of databases that may be used include AMA Guides 6th Edition, ODG by MCG, CA-MTUS, PubMed, Cochrane, and Google Scholar.
He provides reports on behalf of both Plaintiff and Defense Counsel, with the variation based on individual Claimant issues and findings.
If desired, redacted examples of his IME reports are available for your review.
If needed, Dr. Nygaard will testify via video conference in depositions or court.
Dr. Nygaard feels his experience and skills precede any court testimony. He recognizes his important obligation to the Client and legal team to transform complex medical information into usable legal strategy, involving analysis of medical records, explaining medical terms, and providing honest orthopedic opinions to the team.
He regards his role as an orthopedic expert witness as a natural extension of his prior teaching experience with physicians, patients, and community organizations. His use of understandable language and examples, combined with an explanation of complex medical and orthopedic topics during communication with jurors or legal professionals, assists in their understanding of the medical issues of the case.
His affable and likable demeanor during depositions and courtroom testimony has a positive influence on his credibility and the case outcome.
Dr. Nygaard is available to travel throughout Minnesota to testify regarding Orthopedic medical-legal issues.
